Privacy Policy

1. Overview

Lot Barrier LLC ("Lot Barrier™," "we," "us," or "our") operates a dealer management platform. This Privacy Policy explains how we collect, use, store, and protect information when you use our platform at lotbarrier.com.

We operate in two distinct roles: as a data controller for information about our dealer subscribers, and as a data processor for the customer data that dealers collect through our platform.

2. Information We Collect

From Dealers (our subscribers):

  • Account information: name, email address, business name, phone number
  • Payment information: processed and stored by Stripe; we do not store full card numbers
  • Business information: dealership details, logo, operating hours, Google review link
  • Vehicle inventory: photos, descriptions, pricing, vehicle details you upload
  • Usage data: how you interact with the platform, features used, login timestamps
  • Domain registration details if you register a domain through us

From End Customers (buyers, trade-in submitters, review submitters) — collected on behalf of dealers:

  • Name and phone number (from lead capture forms)
  • Vehicle purchase intent and payment method preference
  • Trade-in vehicle photos (VIN, odometer, exterior)
  • Star ratings and private feedback (from review interception)

Automatically collected:

  • IP addresses, browser type, device type
  • Pages visited, time on site, referral URLs
  • Cookies and similar tracking technologies (see Section 7)

3. How We Use Information

Dealer account information is used to:

  • Provide, maintain, and improve the platform
  • Process payments and manage subscriptions
  • Communicate with you about your account, updates, and support
  • Enforce our Terms of Service
  • Comply with legal obligations
  • Send product updates and marketing communications (you may opt out at any time)

End customer data is used solely to:

  • Display lead information to the dealer subscriber
  • Send SMS notifications to customers on behalf of the dealer (with dealer-configured messaging)
  • Generate AI-assisted appraisals and draft responses for the dealer's review
  • We do not use end customer data for our own marketing purposes

4. AI Processing of Data

When dealers use AI-powered features, certain data is transmitted to Anthropic (our AI provider) for processing:

  • Listing copy generation: Vehicle details (year, make, model, mileage, price) are sent to generate descriptions
  • Lead follow-up drafts: Buyer name, vehicle of interest, timeframe, and payment method are sent to generate SMS drafts
  • Review response drafts: Star rating and private feedback text are sent to generate response drafts
  • Trade-in appraisals: Vehicle photos (containing VIN, odometer, exterior) are sent for analysis

Data transmitted to Anthropic is subject to Anthropic's Privacy Policy. We do not transmit personally identifiable information such as full names, phone numbers, or addresses to Anthropic for AI processing.

5. Data Sharing and Disclosure

We do not sell your personal information or your customers' personal information to third parties. We share information only in the following circumstances:

  • Service providers: Stripe (payments), Supabase (database hosting), Twilio (SMS), Vercel (hosting), Cloudflare (DNS/domains), Anthropic (AI processing). Each is bound by data processing agreements.
  • Legal requirements: When required by law, court order, or governmental authority
  • Business transfers: In connection with a merger, acquisition, or sale of assets, with notice to affected users
  • Protection of rights: To protect the rights, property, or safety of Lot Barrier™, our users, or the public

6. Data Retention

  • Dealer account data: Retained for the duration of your subscription plus 90 days, then deleted or anonymized unless required by law
  • Lead and customer data: Retained for 12 months from collection, then deleted
  • Trade-in photos: Retained for 6 months, then deleted from our storage
  • Payment records: Retained for 7 years as required by tax law
  • Usage logs: Retained for 90 days

You may request deletion of your account data at any time by contacting privacy@lotbarrier.com. We will process deletion requests within 30 days.

7. Cookies

We use cookies and similar technologies for authentication (keeping you logged in), security, and basic analytics. We do not use advertising cookies or sell cookie data. You can control cookies through your browser settings, but disabling cookies may affect platform functionality.

8. Security

We implement industry-standard security measures including encryption in transit (TLS/SSL), encryption at rest, access controls, and regular security reviews. However, no system is completely secure. We cannot guarantee the absolute security of your information and are not responsible for unauthorized access resulting from factors outside our reasonable control.

In the event of a data breach that affects your personal information, we will notify you as required by applicable law.

9. Your Rights

Depending on your location, you may have rights including:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request correction of inaccurate information
  • Deletion: Request deletion of your personal information
  • Portability: Request your data in a machine-readable format
  • Opt-out of marketing: Unsubscribe from marketing communications at any time

10. California Privacy Rights (CCPA)

California residents have additional rights under the California Consumer Privacy Act. You have the right to know what personal information we collect, the right to delete personal information, the right to opt-out of sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising your rights. To submit a verifiable consumer request, contact privacy@lotbarrier.com.

11. Children's Privacy

Lot Barrier™ is not directed to children under 13, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, contact us and we will delete it.

12. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes by email and by posting a notice on the platform. Your continued use after the effective date constitutes acceptance of the updated policy.
